Saa Rules and Regulations

The DACS is a neutral set of rules for the description of archives, estates, and manuscript collections that can be applied to all types of records, and represents the United States` implementation of international standards (i.e., ISAD [G] and ISAAR [CPF]) for the description of archival records and their creators. 14.1 If the User`s journey involves a final destination or stopover in a country other than the country of departure, the Warsaw Convention may apply and the Convention regulates and, in most cases, limits the liability of SAA or its partners in the event of death or personal injury, as well as for the loss or damage of Baggage. See also the notices entitled “Notice to International Users on Limitation of Liability” and “Notice on Limitations of Liability for Baggage”. 14.2 As used in this Agreement, “Ticket” means this User Ticket and Baggage Check-in or, where applicable, this Itinerary/Receipt, in the case of an Electronic Ticket to which these Terms and notices belong, “Carriage” equivalent to Carriage”, “SAA or its Partners” means all SAA airlines or its partners that carry or undertake to carry the User or his Baggage under this Contract or undertake to: “Electronic Ticket” means the itinerary/receipt issued by OR on behalf of SAA or its partners, electronic coupons and, where applicable, an on-board document. “WARSAW CONVENTION” means the Convention signed at Warsaw on 12 October 1929 for the Unification of Certain Provisions Relating to International Carriage by Air, or the Convention signed at Warsaw on 28 October 1929. September 1955 in The Hague modified, as applicable. 14.3 Carriage under this Contract is subject to the rules and limitations of liability set forth in the Warsaw Convention, unless such carriage is not “international carriage” within the meaning of this Contract. 14.4 To the extent that this is not contrary to the aforementioned Carriage, other services provided by each SAA or its partners are subject to: (i) the terms and conditions contained in the Ticket; (ii) the applicable tariffs; (iii) the conditions of carriage of SAA or its partner and related provisions that form part of this Agreement (and are available upon request at the offices of SAA or its partners), with the exception of carriage between a place in the United States or Canada and a place outside the states to which the tariffs applicable in those countries apply. 14.5 SAA or the name of its Partner may be abbreviated in the Ticket, with the full name and abbreviation indicated in the fares, conditions of carriage, regulations or schedules of SAA or its Partner; The address of SAA or its partner is the airport of departure indicated in front of the first abbreviation of SAA or the name of its partner on the ticket; the agreed stopovers are the places indicated on this Ticket or as in the schedules of SAA or its partner such as the scheduled stops on the User`s itinerary; Carriage under this Agreement by several successive ASAs or their partners shall be considered as a single operation. 14.6 An airline ASA or its partners who issue a ticket for carriage on the routes of another air SAA or its partners do so only as an agent. 14.7 Any exclusion of liability or limitation of liability of SAA or its partners applies to the agents, servants and representatives of SAA or its partners, as well as to any person whose aircraft is used by SAA or its partners for transportation and to its agents, servants and agents. 14.8 Checked baggage will be handed over to the holder of the baggage check.

In the event of damage to baggage carried in international transport, the claim must be addressed in writing to SAA or its partners immediately after the discovery of the damage and at least within seven days of receipt. See fares or conditions of carriage for non-international carriage. 14.9 This Ticket is valid for carriage for one year from the date of issue, unless otherwise specified in this Ticket, the Fares, the Conditions of Carriage or the related regulations of SAA or its Partner. The freight rate under this Agreement may be changed prior to the commencement of carriage. SAA or its partners may refuse carriage if the corresponding fare has not been paid. 14.10 SAA or its partners undertake to do their best to transport the User and the Baggage with appropriate handling. The times indicated in the schedules or elsewhere are not guaranteed and do not form part of this contract. SAA or its affiliates may, without notice, replace SAA alternative or its partner or aircraft and, if necessary, modify or omit the stopovers indicated on the ticket. Schedules are subject to change without notice.

SAA or its partners assume no responsibility for establishing connections. 14.11 Users must comply with government travel requirements, provide the required exit, entry and other documents and arrive at the airport at the time set by SAA or its partners or, if no time is set, early enough to complete the departure procedures. 14.12 No agent, servant or representative of SAA or its affiliates has the authority to modify, modify or waive any provision of this Agreement. 14.13 SAA OR ITS AFFILIATES RESERVE THE RIGHT TO REFUSE CARRIAGE TO PERSONS WHO HAVE PURCHASED A TICKET IN VIOLATION OF APPLICABLE LAW OR THE TARIFFS, RULES OR REGULATIONS OF SAA OR ITS PARTNER. 14.14 NOTICE TO INTERNATIONAL USERS ON LIMITATION OF LIABILITY 14.14.1 If your journey involves a destination or stopover in a country other than the one from which you are departing, the Warsaw Convention may govern the liability of all airlines involved in your journey, including part of it in a single country. This Convention limits the liability of airlines for death or personal injury, as well as for loss of or damage to baggage. Many air SAAs or its partners have waived the limits of the Warsaw Convention in the event of personal injury or death, claiming that they have taken all necessary measures to avoid harming the first 100,000 Special Drawing Rights of such a claim. 14.14.2 In addition, in the event of death or personal injury, many air ASAs or its partners pay advances to the person entitled to compensation if this is necessary to meet immediate economic needs, in proportion to the difficulties suffered. In accordance with Council Regulation (EC) No 2027/97 (`the Regulation`). The ASA “Community Aviation” or its partners within the meaning of the Regulation make these payments to the person entitled to compensation. Other air SAAs or its partners may apply different provisions.

14.14.3 Therefore, you must inquire about the conditions applicable to your trip. The conditions of carriage of each airline involved in your trip, including its limitations of liability, are available from that airline. 14.15 NOTICE OF LIMITATION OF BAGGAGE LIABILITY Liability For loss, delay or damage to Baggage is limited unless a higher value is specified in advance and additional charges are paid. For most international travel (including domestic portions of international travel), the liability limit is approximately $9.07 per pound ($20 per kilogram) for checked baggage and $400 per user for unchecked baggage. For travel exclusively between U.S. points, federal regulations require that an airline`s liability for baggage be at least $1250 per user. For certain types of items, an overvaluation can be explained. Some SAAs or its affiliates assume no responsibility for fragile, valuable or perishable items. For more information, please contact SAA or its partners. 14.16 DENIED BOARDING DUE TO OVERBOOKING In countries where denied boarding compensation schemes apply, SAA or its partners apply compensation plans for users with confirmed bookings who are denied boarding due to unavailability of seats due to overbooking.
